The lawsuit, filed in U.S. District Court for the Northern District of Texas, according to The New York Times, claims that Apple and OpenAI “locked up markets to maintain their monopolies and prevent innovators like X and xAI from competing.”

OpenAI’s spokesperson said that the lawsuit was “consistent with Mr. Musk’s ongoing pattern of harassment.”

Musk has been threatening legal action over “an unequivocal antitrust violation” for a couple of weeks now. Moreover, he wanted to ban all Apple gadgets at his companies last year because of the company’s integration of OpenAI services.

He believes Apple is “behaving in a manner that makes it impossible for any A.I. company besides OpenAI to reach #1 in the App Store.” What’s more, this partnership would allow ChatGPT to get ahead of the competition thanks to access to iPhone users’ queries, which would help it develop even more quickly.

But Apple is not the only big tech company OpenAI is working with. In 2024, following its collaboration with Microsoft, Musk, who was one of the founders of OpenAI, filed another lawsuit, accusing it of violating their founding agreement to create AI for the betterment of humanity and not profit.
